New Data Regulation (“Data Act”)

Regulation (EU) 2023/2854, known as the Data Act, sets out harmonized rules on fair access to and use of data within the European Union. Directly applicable in Portugal, it aims to remove barriers in the data market by defining who can access and use data generated by connected products and related services, under which conditions, and on what basis. By ensuring a fair distribution of data value among stakeholders, the Regulation seeks to foster innovation, competitiveness, and transparency.
